These Terms and Conditions are the agreement between you and Yumi. By downloading, installing, or using the app, you agree to them.
1. Agreement to these terms
By downloading, installing, or using the Yumi app ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Yumi ("we", "us", or "our"), the operator of Yumi.
2. Eligibility
You must be at least 14 years of age to use Yumi. By creating an account, you confirm that you are 14 or older.
If you are between 14 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We reserve the right to suspend or terminate any account we reasonably believe belongs to a user under 14 years of age.
3. Your account
3.1 Registration
To use Yumi, you must create an account using a valid email address and name, or by authenticating via Sign in with Apple or Sign in with Google. You are responsible for maintaining the security of your account credentials.
3.2 Account responsibility
You are responsible for all activity that occurs under your account. Notify us immediately at contact@getyumi.fit if you suspect unauthorised access to your account.
3.3 Account termination
You may delete your account at any time via Settings > Help & Support > Delete My Account within the App. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
We reserve the right to suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or use the App in a manner that could cause harm to us or other users.
4. The app and service
4.1 Fitness tracking
Yumi provides a workout logging and progressive overload tracking tool. The App is intended for general fitness informational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning any new exercise programme.
4.2 Collectibles, coins, and duplicates
Yumi includes a collectible rewards system. The following terms apply to all virtual rewards and currency within the App:
- Completing a workout earns a blind box, which contains a randomised collectible figurine. The outcome of each box is determined by random chance, with published probability rates for each rarity tier.
- Coins are the App's virtual currency. They are earned through gameplay — for example, by exchanging duplicate collectibles you already own. Coins cannot be purchased with real money.
- Coins may be spent within the App on cosmetic content such as themes, app icons, and widget skins, and on additional blind boxes.
- Collectibles are cosmetic items only. They provide no gameplay advantage.
- All virtual currency and collectibles have no real-world monetary value, are non-transferable between accounts, and are not redeemable for cash, goods, or services.
- Virtual currency and collectibles are licensed to you, not sold. They remain the property of Yumi at all times.
- We do not guarantee the continued availability of any collectible, theme, or virtual item. We reserve the right to modify, retire, or replace virtual items at any time.
4.3 Probability disclosure
In compliance with App Store and applicable platform requirements, the probability rates for each rarity tier of collectible blind boxes are disclosed within the App at the point of opening a box. These rates are:
- Common: 70%
- Uncommon: 20%
- Rare: 10%
4.4 Subscriptions and billing
Some Yumi features require a paid subscription, accessed behind a paywall within the App. The following terms apply:
- Yumi offers an auto-renewing subscription, which may begin with a free trial (currently 2 days). Pricing and trial length are shown in the App before you subscribe.
- Payment is charged to your Apple Account through the App Store at confirmation of purchase. We never receive or store your payment card details.
- Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple Account settings. Deleting the App does not cancel a subscription.
- Except where required by applicable law, payments are non-refundable. Refunds for App Store purchases are handled by Apple under their policies.
5. Acceptable use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms
- Attempt to reverse engineer, decompile, or extract the source code of the App
- Attempt to manipulate, exploit, or circumvent the virtual rewards system
- Use automated scripts, bots, or other tools to interact with the App
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Engage in any conduct that could damage, disable, or impair the App or its servers
6. Intellectual property
All content within the App, including but not limited to the Yumi name and logo, collectible artwork, character designs, interface design, and written content, is owned by or licensed to Yumi and is protected by intellectual property law.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial purposes in accordance with these Terms. No other rights are granted.
You may not reproduce, distribute, modify, or create derivative works based on any content from the App without our prior written consent.
7. Disclaimers and limitation of liability
7.1 No fitness or medical warranty
The App is provided for informational and motivational purposes only. We make no representation or warranty that the App is suitable for your individual fitness needs or health condition. Use the App at your own risk.
7.2 Service availability
We do not guarantee that the App will be available at all times or free from errors. We may suspend, modify, or discontinue the App at any time without notice.
7.3 Limitation of liability
To the maximum extent permitted by applicable law, Yumi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including loss of virtual items or currency.
Our total liability to you for any claim arising from use of the App shall not exceed the greater of (a) the amount you have paid to us in the twelve months preceding the claim, or (b) USD $100.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
8. Third-party services
The App may integrate with or link to third-party services including Apple and Google authentication providers. We are not responsible for the content, privacy practices, or availability of any third-party service. Your use of third-party services is governed by their own terms and privacy policies.
9. Changes to the app and these terms
We may update the App and these Terms at any time. When we make material changes to these Terms, we will notify you via the App or by email. Your continued use of the App after the effective date of any update constitutes your acceptance of the revised Terms.
Additional terms may apply to specific paid features, and will be presented to you at the point of purchase.
10. Governing law and disputes
These Terms are governed by the laws of Australia, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or your use of the App shall first be subject to good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to the courts of Australia, which shall have exclusive jurisdiction.
If you are a consumer resident in the EU or UK, you may also be entitled to use alternative dispute resolution mechanisms available in your country.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
12. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yumi with respect to your use of the App and supersede all prior agreements.
